Baltimore Sun reporter Kevin Rector has a touchy-feely article in the July 18th edition of the Calvert Street Communist Party Newsletter detailing how grief and remorse settled over a Baltimore County Courtroom in the case of Matthew David Miller, who pled guilty to one measly count of manslaughter in the hit-and-run murder of Kevin M. Ryan in October of 2007.
Ryan was walking along that section of Hillen Road in Towson between Courthouse Square Apartments and the Baltimore County Resevoir near Donnybrook Apartments when he was struck by Miller early in the morning. His body was thrown into traffic, where he was hit again, and died on the scence. Miller hid his car in an alley, then claimed it was stolen.
Nice guy, this Matthew David Miller of Kendale Road. Ahh, Kendale Road. My old stomping grounds. Its quite a shame that assholes like this moved into the neighborhood. Used to be a great place to grow up. In fact, O'Guvnah's brother in law owns a house right behind the Millers.
My favorite line in the article is the statement by so-called Judge Robert Dugan, who though finding Miller "cowardly", couldn't possibly sentence him to the state penitentiary, because it was a "hellhole". Well, I guess Kevin Ryan's grave hole isn't quite a hellhole. I hope if one of my family is ever murdered by a ratfucking little spoiled brat college kid, Robert Dugan isn't on the bench.
But could all of this have been avoided? I asked, because the original indictment included charges of Negligent Homicide while Operating a Vehicle Impaired, Under the Influence, and Under the Influence of Alcohol.
So I did some digging, and guess what? This isn't Matthew David Miller's first run in with the law on drug and alcohol issues. In fact, in 2005, Matthew David Miller was charged with with CDS possession of marijuana and paraphenalia. But, the case was placed on the STET document as the prosecutor made the decision to Nolle Pros the charges. Assistant State's Attorney Kim Detrick made that call.
I wonder if ASA Detrick regrets that decision now. Because Kevin Ryan is dead, and the charging officer in his death felt there was reason enough to charge Matthew David Miller with being under the influence.
That is the remorse that should have been in the courtroom. The county screwed the pooch, and a promising young man is dead.
